Current Need

McKesson’s well-regarded General Counsel Organization is seeking an experienced healthcare transactional lawyer to support the McKesson Health Systems (MHS) customer segment (which includes hospitals, health systems, integrated delivery networks, long term care and alternate site providers) for both US Pharma distribution and its subsidiary, McKesson Plasma and Biologics LLC (“MPB”). MPB also owns a group purchasing organization, Pathway, which offers marketing, reimbursement support and data analysis value-added services to its members. The successful candidate will be responsible for providing contract and regulatory legal support for MPB, Pathway and PACT, and supporting other strategic initiatives.

McKesson’s U.S. Pharmaceutical Distribution business (US Pharma) supplies pharmaceuticals and other healthcare-related services and technology products to a wide range of retail and institutional pharmacy customers. US Pharma’s nation-wide network of distribution centers supplies medication to 1/3 of all health care providers in the United States, and we frequently invest in technology and other systems to enhance the safety and reliability of our core distribution services and technology offerings.

Position Description

  • Responsible for senior legal support forcontract drafting, negotiation and strategy for our hospital and providercustomers (regional group purchasing organizations, acute care and specialtypharmacy customer contracts, state and local government contracts)

  • Provides health care regulatory advice (AKS) relatedto discount, administrative fee payment and personal services arrangements,false claims, antitrust, privacy and 340B;

  • Works collaboratively with the compliance, ContractDevelopment Managers and operations teams;

  • Manages 2 legal professionals (ContractSpecialists) who provide cross-functional support to MHS and other US Pharmabusinesses;

  • Serves as the legal advisor to MHS leadership ona wide array of topics relating to the customer segment needs, includinglegal risk mitigation, customer relationship management and retention, andservice offerings; and

  • Frequent interactions with other internalstakeholders across functional groups (contract development, credit, pricing,operations, cross-General Counsel Organization stakeholders and experts).

Minimum Requirements

10 years of corporate law experience

Critical Skills

  • Excellent commercial contract drafting and negotiation skills

  • High comfort providing health care regulatory advice (anti-kickback law, FCA, privacy, 340B, government contracting, antitrust) as well as commercial legal advice

  • Preference for experience in the hospital or health system space and/or negotiating commercial contracts with health care providers

  • Proven management experience, and a strong desire to develop and manage high-functioning legal professionals

  • Outstanding verbal and written communication skills

  • Excellent interpersonal skills with an ability to provide sound, clear legal advice to all levels within the company, including senior business executives

  • Ability to work closely with, facilitate interactions within, and influence large cross-functional teams (including representatives from other areas of the General Counsel Organization regulatory and compliance professionals, sales professionals and operations managers)

  • Notable business acumen dealing with risk management and organizational savvy

  • Must be a team player who can develop strong working relationships and work collaboratively with internal clients and other members of the legal team

  • Ability to lead by example including a willingness to “roll up your sleeves” and undertake day-to-day legal work

  • Law firm experience combined with in-house experience, preferred

Juris Doctor Degree with excellent academic credentials. Member of a jurisdiction is required.
